The speed you were travelling at prior to the impact
Whether the turning vehicle was indicating
If the turning vehicle was not indicating, should it have been obvious in any way that the vehicle was going to or was about to turn or pull out?

Factors law will take into account that's it

I'm imagining undertaking someone on a road in good conditions at a reasonable speed and I can foresee loads of possible dangers but I'm in a relatively low gear and I've got the brake covered so alls good. That diagram looks like I'm going to overtake someone oncoming on their left hand side ? Now I've probably done this too, but we're talking about some mega congested roads around a major attraction when the traffic is virtually stood still.
It all boils down to what you feel comfortable doing and if there are any cops or cameras
