Was it an ebay purchase? And how was it listed? If the listing said 'possible blown head gasket etc' then not a leg to stand on but if not you could just return it under the sale of goods and services act.
I went to cornwall with Dave (radicalrabbit) last year to pick up the same bike, rode home to his fine bit as he was cleaning and re-tuning the next day he noticed lots of structural rust, blown exhaust headers etc etc, nevertheless he took it back and got a full refund. This was a private sale and the buyer was a regular ebay seller and didn't want to lose his good seller rep.

That's one smokey bike smudge ......if you knew the probs on it beforehand , fair enough but if not , I think this is going to be a never ending problem of paying out all the time . Don't know if to rebuild engine or get one from scrapyard the bikes got full service history and had a lot spent on it
